“Notification Act in force”
On March 1st, 2009, the new Notification Act #8687 became effective. This innovative Act comprises important and innovative topics such as provisions to ensure handicapped are able to understand the documents served to them and the possibility of serving parties through electronic and computer devices. Additionally, some notification methods foreseen by the previous law have been further regulated. Hence, it is still possible to give notice to parties by means of a Notary Public, through electronic devices such as fax among others.
This piece of legislation obeys and provides a solution to the current need for developed and dynamic communications.
Some of the innovations in the new law are the requirement to proceed with notification through fax, P.O. boxes and e-mail, or the possibility to set a permanent electronic address where the parties, without delay could receive even the first notice on an initiating court procedure. This is evidently an additional step towards the implementation of a digital file which without a doubt will expedite the process and resolution of judicial procedures.
